If your creditors have been pursuing unpaid debt you may be in a situation where you’re faced with a CCJ (County Court Judgement). A CCJ is one of the ways in which a creditor can try to claim back the money you owe them.
Here are a few Q&As to help clear up some queries you might have about Debt Management and CCJs.
Do I have to discuss my CCJ with you?
Keeping financial worries bottled up isn’t just bad for your stress levels; it isn’t going to help you come to a solution either. When you’re faced with a CCJ it can be easy to feel there are few debt management options available to you.
We’ve built up many years experience dealing with all sorts of debt worries, from relatively small amounts to more substantial sums. So when it comes to discussing your CCJ, there’s no need to feel embarrassed about giving us the detail we need to try to help you with debt management.
I already have a CCJ, can I enter into a Debt Management Plan?
Your CCJ should not prevent you from getting help with a Debt Management Plan. Once you’ve spoken to our advisors about debt management we’ll ask for full details of your CCJ as part of our initial assessment of your finances.
It’s important you continue with the payment schedule set out by your CCJ, as agreed with the courts, until we advise you to stop. When your Debt Management Plan is in place we’ll help you make payments to the creditors who have issued you with the CCJ and we can then apply to the courts on your behalf to try to get an amended arrangement in place.
I have several creditors plus a CCJ, how do I ensure everyone gets paid?
Our role in helping you with debt management means we’ll take all your creditors into account and look at the best way to distribute your Debt Management Plan monthly payments. Any CCJ payments will usually be given priority when we’re working out how best to apportion your payments.
Is it possible for my creditors to issue me with a CCJ once I have agreed on a Debt Management Plan?
It’s important to understand that whilst many creditors will see your Debt Management Plan as a sensible alternative to unpaid mounting debt, a Debt Management Plan is not legally binding. This means your creditors could still take action against you and start the process of applying for a CCJ, even if you are on a Debt Management Plan. By keeping us informed it’s more likely we’ll be able to offer you the right advice if your situation changes.
